A recent episode of the Small Business Rundown podcast has sounded the alarm on the Beneficial Ownership Information (BOI) reporting requirement, calling it a persistent and serious threat to small businesses across the country. The episode featured NFIB member Nancy Marr, U.S. Representative Brad Finstad, and NFIB's Josh McLeod, who each broke down why the rule remains so burdensome for Main Street.
The BOI rule, part of the Corporate Transparency Act, requires many small business owners to file detailed personal information with the Financial Crimes Enforcement Network. Critics argue it places an unfair compliance load on small firms while doing little to stop actual financial crime. During the podcast, Nancy Marr shared her firsthand experience with the confusing paperwork and the fear of steep penalties for simple mistakes. Representative Finstad discussed ongoing legislative efforts to delay or repeal the mandate, emphasizing that Congress never intended to drown small businesses in red tape. Josh McLeod added that despite court challenges and some deadlines shifting, the requirement is still very much alive, and owners need to stay informed to avoid fines that can run into hundreds of dollars per day.
The conversation made clear that for many mom-and-pop shops, the BOI rule is not a solved problem. It remains a looming deadline that demands time, money, and legal advice that many small operations simply do not have.
